NIC's manufacturing partner has conducted a review of relevant export classifications for our supercapacitor products. We have identified five (5) unique supercapacitor part numbers ("Identified Products") which appear to meet the description in Category XI(c)(5) of the United States Munitions List ("USML") and thus are subject to export control restrictions under the United States International Traffic in Arms Regulation ("ITAR"). The Identified Products are attached hereto as Attachment 1 We are temporarily suspending all shipments of the Identified Products until we determine our obligations under ITAR and develop procedures to resume shipments of the Identified Products. If we are able to resume shipments of the Identified Products in the future, we will provide an updated statement. Please be advised that you must treat the Identified Products as subject to the ITAR and USML Category XI(c)(5). This means that a U.S. Department of State, Directorate of Defense Trade Controls ("DDTC") license or other government approval may be required prior to the export, reexport, retransfer, temporary import, or any other sales or sales-related activity related to the Products and involving a Foreign Person (as defined in 22 CFR §120.63) or any country that is not the U.S. In the event there is a revision to the USML which results in a change to the export classification of the Identified Products, we will provide an updated statement.
